Penalties for DUI Conviction
Convictions for DUI require that the court sentence a defendant to certain minimum mandatory sentences. These minimum mandatories are the lowest permissible sentence allowed by law. They do not allow discretion for the judge to go any lower absent a breakdown of the DUI charges to reckless driving. All DUIs for which there are convictions require the court to adjudicate a defendant guilty. This means that a conviction for DUI may never be sealed.
Penalties for DUI first offense require a minimum of the following:
- six months reporting probation;
- $250 fine;
- Six months driver's license suspension;
- Fifty hours of community service;
- Attend and complete Level I DUI school;
- Ten day immobilization of vehicle; and
- Court costs.
Maximum sentences include:
- A jail sentence of six months;
- A $500 fine;
- One year driver's license revocation;
- A longer period of vehicle immobilization;
- A longer period of community service hours; and
- Court costs.
